Conditions | | - 1.Service is provided under BT's `Conditions for Private Services'.
- 2.The minimum period of service for Wavestream beginning on the day when Service is first made available is 12 months. In the event that Service is terminated within the minimum period the remainder of the rental charges will be payable.
- 3.Wavestream services are available subject to survey to ensure the accuracy of the information provided by the customer while obtaining a quote and to check feasibility. Where service cannot be provided, the order will be cancelled without liability.
- 4.Each quote is valid for a period of 30 days.
- 5.Where customers require one or both ends of their 2.5Gbit/s wavelength to be moved within the same building (internal shift), network Timescale rates will apply (see Section 15 Part 8). Customers, however, have to be aware some downtime is inevitable during the move and BT will only proceed on the grounds that customers accept this downtime. The shift will be subject to the customer's new network meeting network design criteria.
- 6.Where customers require one or both ends of their 2.5Gbit/s wavelength to be moved to a new building (external shift), then connection charges for the site or sites being moved will apply. Core Network Connection Charges. Rentals for annual contracts will be recalculated following an external shift. Rentals for fixed price contracts will be recalculated at the rates applicable when the contract was originally signed or the prevailing rates whichever is lower following an external shift. As with an internal shift, customers have to be aware that some downtime is inevitable during the move and BT will only proceed on the grounds that customers accept this downtime. The shift will be subject to the customer's new network meeting network design criteria.
- 7.Where customers request to cease one or more Wavelengths in their Wavestream network configuration, the entire Wavestream network may have to be re-configured accordingly. Such cases will only be progressed by BT on the condition that customers accept an agreed downtime period to allow the re-configuration to be completed.
- 8.Upgrades and migration to Wavestream products from other Private Circuit products are currently not available for those products still within the terms of the existing contracts.
- 9.Charges for infrastructure over and above standard requirements for the provision of Wavestream will be made as additional charges to the customer as described in Section 45 Part 1
- 10.Cancellation charges will apply, as described below.

Wavestream 10G Regional services are capable of providing up to 8 multiple sub rate circuits (subject to not exceeding the 10G trunk wavelength capacity). The Customer may opt not to fully populate this card from day one of its 10G trunk wavelength. To activate further trunk capacity on this 10G wavelength, a one off subrate connection fee will be applicable. This service of additional subrates will not be applicable to Customers who require the full 10G bandwidth on a single interface (such as STM-64 or 10G Ethernet) that will not be provisioned on the 8 port Muxponder card. |

1.The Minimum Period for Wavestream beginning on the day when Service is first made available is 12 months. If Service is terminated before the end of the Minimum Period, the remainder of the rental charges for the Minimum Period will be payable. 2 If the Customer has ordered Service for longer than 12 months and terminates the contract before its expiry date, they must pay BT any outstanding connection charges plus all charges for the remainder of the first 12 months together with 20%of the rental that would otherwise have been payable for the remainder of the contract period. 3.Cancellation charges will apply, as described below.

The shift will be subject to the Customer's new network meeting network design criteria. 7. If the Customer requests cessation of one or more Wavelengths in its Wavestream network, it may be necessary to reconfigure the entire Wavestream network. Such cases will only be progressed by BT on condition that the Customer accepts an agreed downtime period to allow the re-configuration to be completed. 8. Upgrades and migration to Wavestream products from other Private Circuit products are not available for those products still within the terms of the existing contracts. 9. Charges for non-standard infrastructure for the provision of Wavestream will incur additional charges as described in Section 45Part 1 10. The standard Wavestream Reduced Charges Scheme applies as outlined in Part 4 titled "Wavestream Reduced Charges Scheme". |
