Additional Conditions |

These Additional Conditions apply to all BT Dial IP services, including but not limited to SurfPort, WebPort Elite and WebPort PAYG, where the Customer uses an access number in the 0870, 0871 or 090x ranges. |
Applications for premium rate number(s) must be accompanied by a copy of the Customers PhonepayPlus, ( formerly ICSTIS - Independent Committee for the Supervision of Telephone information Services) certificate. Orders for premium rate numbers will not be progressed without this certificate. |
Customers must comply at all times with any code of practice, as published and amended from time to time by PhonepayPlus, ( formerly ICSTIS ), or any other competent authority, which applies to or otherwise affects the Service. Customers must abide by any instruction, direction, recommendation, opinion or advice that PhonepayPlus, ( formerly ICSTIS ), gives with regard to the Service. |
Customers must, on request, provide BT or PhonepayPlus, ( formerly ICSTIS ), (or both) with such information or material relating to the Service or a future Service as BT or PhonepayPlus, ( formerly ICSTIS ), (or both) may reasonably request in order to carry out any investigation in connection with the Service. |
A recovery charge per minute will be made to customers for all fixed fee calls that exceed a duration of 1 minute. The charge will be recovered from associated revenue share payment. At the point at which no more revenue share is available to be recovered, charges will be generated in the form of a bill. |
Neither the Customer nor anyone on their behalf may access the Service, other than at what BT considers to be reasonable intervals for the purpose of testing that the Service is operating correctly. |
The Customer's service must not be used in connection with the carrying out of a criminal offence against BT or any other public telecommunications operator, including the artificial inflation of traffic to the Service. |
The Customer will not be entitled to any revenue share payment from BT in respect of End-user access where: - -an End-user does not pay the appropriate call charge to BT or any other public telecommunications operator; or
- -an End-user accesses the Customer's service via the network of another licenced operator and the other licenced operator witholds payments to BT in respect of those calls.

Where an End-user witholds any part of a payment due to BT, because the payment includes charges for access to the Customer's Service, BT shall be entitled to deduct an equal amount from any revenue share payment due to the Customer. The revenue share payment may be witheld until the End-user completes their payment to BT. |
These Additional Conditions form part of the Customer's contract with BT. In the event that the Customer fails to comply with these Additional Conditions, BT reserves the right to suspend or terminate the Service, as described in the BT WebPort Terms and Conditions. |
BT reserves the right to withold revenue share payments due to the Customer, without notice, if BT has reason to believe that the Customer is in breach of its contract with BT for the Service. The revenue share payments will be made only when BT is satisfied that the Customer is not in braech of that contract. |
Where BT satisfies itself that the Customer is in breach of its contract for the Service, the Customer will not be entitled to any revenue share that would otherwise have been due to the Customer, in respect of access to the Service, whilst it was in breach of its contract for the Service. |
Where BT has already paid revenue share to a Customer in respect of access to the Service, but where the Customer is not entitled to that revenue share under its contract, BT may: - -deduct an amount equal to the amount of revenue share to which the Customer was not entitled from any Call Payment due to the Customer under this or any other contract with BT; or
- -demand payment of such amount or the balance of such amount from the Customer within 14 days; or
- -deduct such amount or the balance of such amount, from any deposit held as security for payment.
