- 1.The committed port price will be fixed for the duration of the Contract, which will be for one or two years.
- 2.A call off option is available, over a maximum period of either 3 months for a 1 year contract, or 6 months for a 2 year contract, effective from the Operational Service Date.
- 3.Contract volumes and monthly call off rates will be agreed and fixed at the time of Contract signature. Customers cannot reduce their contracted volume or the rate of call off. The contracted call off rate must be at or above the rate detailed in the table below:

| - 4.Customers will be billed in accordance with the agreed call off rate.
- 5.Customers may, upon application to BT, increase their contracted volume or rate of call off.
- 6.The Contract term for additional port quantities will commence on the Operational Service Date of the additional ports. Timescales for the delivery of increased volumes of ports will be provided on application.
- 7.Customers terminating the Service before the expiration date of a 1 year contract, must pay to BT the outstanding charges, in a single payment, that would have been received if they had completed the period of the contract. Customers terminating the Service before the expiration of a 2 year contract, must pay to BT all outstanding charges for the first year (if any) together with 35% of the outstanding charges from the second year (as appropriate), in a single payment, that would have been received if they had completed the period of the contract.
- 8.Customers can combine their SurfPort volumes with SurfPort24 or SurfPort Plus to achieve the best volume discount that is appropriate, e.g. 10k SurfPort24 and 10k SurfPort24 will entitle the Customer to the band which applies to 20k ports for each product. Note that only a single SurfPort and a single SurfPort24 and a single SurfPort Plus order can be combined to achieve the best available price (i.e. multiple , SurfPort and SurfPort24 and SurfPort Plus orders cannot be combined).
- 8.1Customers have the flexibility to split their volumes between SurfPort, SurfPort24 and SurfPort Plus, subject to the customer's total combined order meeting the minimum order quantity for the relevant products i.e. 500 for SurfPort and SurfPort24 and 1500 for SurfPort Plus, and subject to the split volumes complying with the minimum order multiples for the customer's volume band. For example, a Customer can have 100 SurfPorts and 400 SurfPort24s, meeting the minimum order quantity of 500 ports. Similarly, a Customer can have 100 SurfPorts, 400 SurfPort24s and 1000 SurfPort Plus, meeting the minimum order quantity of 1500. A Customer with 10,000 ports and above could split their service up into 250 SurfPorts, 250 SurfPort24s and 9500 SurfPort Plus.
- 9.Ports are charged, monthly in advance, all call charges and revenue share payments will be made a month in arrears.
- 10.Additional numbers - Customers will be entitled to free `Dial In' numbers from each of the applicable number ranges, up to the quantities shown in the table - Port Charges. Any additional numbers will be charged at the rates shown in the table - Additional Charges.
- 11.Customers migrating from the other BT dial access services, or from the dial access services of other network operators or ISPs will be able to port their existing free-phone or value-call numbers to the service. In such circumstances the last six digits of the number must be unique.
- 12.BT's standard minimum call charge will apply to all 0845, 0870, 0911 and 0844 09xxxx call charges.
- 13.All free call (0808/0800) calls will be subject to a minimum call charge of three pence for the first minute, or part thereof.
- 14.The standard delivery times for services will apply - namely 75 working days. The standard lead-time for service delivery will apply - 75 working days from BT acceptance of the contract, subject to satisfactory survey.
- 15.Charging will commence on the Operational Service Date.
- 16.Migration from WebPort to SurfPort
- 16.1Migration from WebPort products, including WebPort Flex and WebPort Elite but excluding WebPort24, to SurfPort is permitted. Customers may migrate, in whole or in part, their existing WebPort volume to SurfPort.
- 16.2Migration from WebPort24 to SurfPort is not permitted.
- 16.3A partial migration can take place following contract amendment, subject to customers migrating no less than the minimum port number applicable to SurfPort and retaining no less than the minimum port number applicable to WebPort. Customers combined, newly contracted WebPort and SurfPort contract volume commitments must be no less than the existing WebPort volume commitment.
- 16.4Customers may migrate the whole of their WebPort volume to SurfPort. In this event, the existing WebPort contract will be terminated and a new contract entered into for SurfPort.
- 16.5In all cases, customers will incur termination charges for the early termination of their WebPort contract. These charges will be calculated as 10% of the termination charge that would have been payable had the customer terminated their WebPort contract without migration to SurfPort. Full termination charges for WebPort products are explained in the Price List at section 28 part 4
- 16.6 Customers migrating to SurfPort will be subject to the conditions applicable to SurfPort.
- 16.7Contracts for WebPort ports migrated to SurfPort will include a Minimum Period of 12 months from when the SurfPort ports are made available to the Customer.
- 16.8The delivery lead-time for migrating the existing WebPort ports to SurfPort will be 75 working days.
- 16.9Charging will commence on the date when the new SurfPort ports are made available to the customer.
- 17.Migration from SurfPort to IPStream:
- 17.1Migration from SurfPort to IPStream is supported on the basis of 5 (five) IPStream end user connections increase to one Dial Port reduction.
- 17.2Customers migrating ports according to these terms and conditions shall not have to pay BT the termination charges described elsewhere in this Price List for those migrated ports.
- 17.3Migration from SurfPort to IPStream is conditional on minimum order quantities and order multiples being complied with for both products.
- 17.4No more than 15% of total delivered ports may be migrated in any twelve month period.
- 17.5Where a customer has multiple contracts, migrated ports will be deemed to be taken from the contract with the shortest term remaining.
- 17.6Where, as a consequence of migration, a customer's contract drops into a lower SurfPort volume band, the customer will be charged at the appropriate increased rate.
- 17.7Following migration IPStream Terms and Conditions will apply as if for a new order.
- 17.8The anticipated leadtime for Dial Port reductions due to migration shall be 30 days from placing the request for migration.
- 17.9Migrations may occur in stages, subject to the applicable port numbers and order multiples in the Price List.
- 17.10 Ports may be migrated once a month. Second and subsequent requests for migration in one month will be held over until the next month.
- 17.11 Where ports are migrated before the completion of any call-off period, the migration shall reduce the final contracted port level. Increased port charges will be payable from the date of migration if this takes the customer into a higher charge band.
- 17.12 SurfPort customers who drop below the specified number of SurfPorts (10,000) will no longer be eligible for the enhanced SLA (but will get basic SLA).
- 17.13 Billing for the new number of ports will commence on the day the migration occurs.
- 17.14 Advance port rentals paid in respect of SurfPort ports migrated to Broadband will be returned to the customer.
