b) Payback

Payback is based on the Customer's weekly total usage of call minutes and is equal to 25% of the prevailing PSTN call charges (excl. VAT) for the time of day the port was used. Payment to the Customer will be made monthly in arrears, subject to an individual minimum payment provision of £1000 per payment. Payment under £1000 will be carried forward to the next payment period and added to any subsequent additional payments generated by the service. If after 3 consecutive months' total revenue share payback has not reached £1000 then the accrued revenue share will be cancelled.

b) Payback

Payback is 8.5p (exc VAT) / 10p (inc VAT) per call. Payment to the Customer will be made monthly in arrears, subject to an individual minimum payment of per payment. Payment under £1000 will be carried forward to the next payment period and added to any subsequent additional payments generated by the service.

54. Banded 0800 (No Longer Available for New Supply)

The banded 0800 option must be contracted for at least 1 year.

There will be a minimum charge for each 0800 call of 3p, for the first minute of each call, irrespective of the per minute tier that applies.

The table below shows the per minute 0800 tariffs which will apply with different levels of customer port utilisation and ports purchased.

To obtain these tariffs the average total Value Call (0800 + 0845 + 0870) utilisation per port per day measured over a month * is used unless the customer specifically requests that only certain Value Call numbers are used.

Customers will pay the 0800 tariff relevant to the highest tier in which all conditions are satisfied. Customers will move up or down the tiers automatically as utilisation or ports change and all minutes will be charged based upon the new tier. For example, if a customer has 2000 ports but only generates 7 hours and 30 minutes worth of calls per day per port, then the higher charge band of 2.3p, 1.0p and .75p for day, evening and weekend respectively will apply. However, if a customer with sufficient ports exceeds a usage threshold, then all his usage that month is charged at the rates of the tier he moves into. For example, if a customer with over 2000 ports exceeds expectations and generates 8 hours 30 minutes when only 7 hours had been expected then all his usage is charged at the lower 2.1p, 0.8p and 0.7p rates not just those minutes above the threshold.

* The utilisation figure is based on time used both during week days and weekend days. Week day and weekend days are averaged separately and both the (a) the weekday and (b) combined weekday and weekend day averages must be seperately achieved for the utilisation for a tier to apply. It will be possible for a customer to purchase several Value Call numbers 0845. 0800. 0870, for use on BTnet Dial IP and if this is done then utilisations can be combined to meet the above tier requirements. This combining and averaging will be done automatically unless the customer requests otherwise. However, each 0800 number (including the first) will be charged at the standard connection and rental rates as per prices within BTnet Dial IP standard price list (£25 connection and £50 per quarter rental (excl VAT)).

65. 0800 Freefone with 12 Port Minimum Requirement (No Longer Available for New Supply) (c)

In addition to the PSTN number included with the port options described above or the revenue share pstn options, a Freefone number such as, 0800 freefone can also be pointed at the ports. The use of this number will be billed at 3p per minute each quarter in arrears. A minimum of 12 ports is required before this option can be used. Connetion and Rental charges will be in line with current Inbound Services charges i.e. £25 connection and £50 per quarter rental (excl. VAT).

76. Free Call Port Pricing for BTnet Dial IP (No Longer Available for New Supply)

Introduction

This option provides the Customer with a fixed weekly usage volume for a set price per port. Any usage above the fixed weekly volume is then charged at a per minute rate as indicated within Table 1.

This service is available for customers wishing to purchase dial ports in excess of 10,000 inclusive of host link charges (installation and rental) to the customer's premises.

Various Tariff options are available depending on the customer's total number of ports and delivery medium.

The offer is based on a set traffic profile and customers who are unable to meet this criteria will be offered the BTnet Dial IP banded 0800 service.

Requirements

The option is based on an Free Call number with two port bands of 10,000 and 50,000 minimum. Each band has an entry option level of 5000 and 25,000 ports for the 10,000 and 50,000 port bands respectively. Customers taking the entry option levels must reach the minimum levels of ports within each band by the end of the sixth month. Should this criteria not be met then the customer will be transferred to the best alternative pricing option available.

Traffic Profile and Variance From Same

Under this option the customer receives 56 hours of usage (averaged over all ports) per week in the following profile:

Variance From Profile

All minutes over 56 hours average usage per week will be charged at 0.999p per minute.

All minutes in the Daytime period over 16.8 hours average usage per week will be charged at 0.999p per minute irrespective of whether the customer achieves 56 hours average usage per week or not.

Charging

Customers will be charged as per table 2.

At the end of each calendar month BT will review :-

1. The average usage per port per week (During the previous month).

2. The average weekly usage Profile (during the previous month).

Where average usage for each port per week averaged over the previous month exceeds 56 hours, then the Customer will be charged for each minute in excess of 56 hours per week at the rate indicated in the Table 1.

Customer Change Requirements

The number of ports may be increased, in increments of 1,000 ports as per table 2.

Each increase in the number of ports will be subject to a new minimum Period of 12 months.

If the Customer terminates any such increase within 12 months of ordering, BT will recover its costs by charging for:-

-The total number of ports supplied at a charge of £140 a port for the 12 month contracted period.

- The host link as per Platinum service charges shown in this Part, for the remainder of the contract period.

87. Per Minute Volume Pricing Option (No Longer Available for New Supply)

Introduction

Customers will be required to commit to generating a volume of traffic “Committed Volume" during each 12-month period and will receive revenue share or discount according to that band.

Service Options

Revenue share is offered for 0845 calls. Starting base is the local call rate

Discount is offered on “Free call" numbers such as 0800 calls. Starting base is 3p per minute for day, evening and weekend.

Each service will have a further option of Internet access.

The service will be configured on a standard level of performance, 30% port utilisation and 20k bit per second per port bandwidth allocation.

Customers requiring different levels of service can purchase additional components at standard Dial IP (BTnet Dial IP and ISPnet Standard Access) prices as shown in this Part.

Volumes across both 0845 and Free call services can be aggregated to get the best offer available.

Delivery Options

Delivery options include Gold, Platinum, Neutral Access Points adjacency and IPSPAN as described in SIN321 and 328.

Additional incentives are given based on the delivery mechanism. Principally the lower cost of the delivery is reflected in higher revenue share and discounts. The maximum delivery speed for Internet access with any delivery option is 155mbps.

Free Call Discounts

Free call is on numbers such as 0800. The discount offered to Customers will depend upon the volumes committed within a 12 month period. Table A2 shows pence per minute BT charges the customer (also represented as a percentage discount of the base rate of 3p per minute).

All Free call calls will be subject to a minimum call charge of three pence for the first minute.

Neutral Access Point (Nap) Adjacency and Ipspan Connectivity Options.

For Customers with network presence in a neutral access point, such as Telehouse and Manchester (MANAP) the interface is a Fast Ethernet presentation in BT accommodation in the Neutral Access Point. The Service Provider will need to provide in-building cabling to connect their network to this presentation.

The service can also be presented as IP over ATM over SDH to a foot-way box approximately 100 metres away from a BT IP core Point of Presence (POP). This IP SPAN option is suited to customers with the capability to take advantage of this delivery.

Customers connecting to the service via IPSPAN or NAP Adjacency will receive an additional percent revenue share or discount (as shown on table a3) to those indicated in table “A1" and “A2" above on the monthly revenue or charge, as applicable.

The additional revenue share or discount will be applied to the monthly bills.

Customers Requiring An Internet Link

Customers who require an Internet link will have their revenue share for 0845 or discount for Free call options reduced by 1% on the total revenue generated at the end of each month as per Table a3 Below.

Conditions for Per Minute Volume Pricing Option

  • 1. The traffic volumes generated by the Customer, will be jointly reviewed by BT's account team and the Customer on a quarterly basis.
  • 2. Underachievement by the Customer will result in BT over-providing Service Components and over-payment and /or over discounting. This will be subject to early recovery measures.
  • 3. The Customer will be required to achieve at least 75% of the monthly run rate (based on the committed volumes) from the end of the 3rd month.
  • 4. Should the Customer not achieve the 75% run rate then BT will stop revenue share payments and/or discounts. For Free call service the customer will be charged the base rate of 3p per minute. Any over payment and/or additional discount given will be recovered from the following months' bills. Overpayment of Revenue Share will be calculated by substracting the average of the lowest revenue share value (i.e. 24 million minutes) from the average of the contracted revenue share band. Revenue share and / or discounts will resume once all the overpayment and discounts have been recovered and the monthly run rate is achieved. By the end of the fourth month the customer must achieve the full monthly run rate.
  • 5. Customers who under-achieve the committed volumes by the end of the 12 month contract will be billed for:-
    • a) The service components including ports, host links and Internet bandwidth at £350 a port. The over provision of service components will be calculated by working out the difference between the minimum level of ports allocated at the committed volume band and the minimum number of ports at the band that they should have selected. For example, a customer committing to 6bn minutes but attaining 3bn minutes will be charged for 38053 ports less 19027 ports i.e. 19026 ports at £350 a port.
    • b) Any overpayment from revenue share or discount.

Over Achievement

Customers wishing to move up a band will give 28 days notice to BT in writing. Upon receiving customer's notification a new 12 month contract will apply from the time the installation is due to be complete. Customer must note that the rules for underachievement will apply once the new contract terms commence.
