IP Clear is a wide area Internet Protocol (IP-VPN) service for the UK market designed to service customers who require connectivity between branches, data centres and operational sites throughout the UK. |
IP Clear is an unbundled product. A router is required to deliver the solution. |
IP Clear Service is available only to those customers who meet the IP Clear eligibility criteria. |
IP Clear is available on a range of contract terms. |
The level of ServiceCare is TotalCare (see Section 14 Part 1). |
IP Clear Eligibility |
Customers must commit to meeting or exceeding the qualification criteria set for IP Clear by the first anniversary of their Contract. |
Description of Charges |
IP Clear charges consist of :- - -An Access Connection charge (`Connection Charge') is a one off charge payable upon successful installation.
- -An annual access rental charge (`Annual Rental Charge') is also applicable to all access types. The Annual Rental Charge is payable quarterly or annually in advance. All Access Connections are subject to a 12 month minimum Contract Term.

Prices for the Service will normally be governed by the location of the Service Point nearest to the Customer's Site. The Customer can request to be served from a different Service Point, which may result in an additional Out of Area charges (details of which are contained in this Part). BT reserves the right not to accept such requests. |

Connection to a single VPN is included within the Connection Charge. Charges for additional VPN Connections are listed in `VPN Service Charges'. |

Leadtimes |
The standard leadtime for delivery of IP Clear accesses is: 128kb/s - 2Mb/s - 35 Working Days. 2Mb/s Secure Plus - 35 Working Days. 34Mb/s - 155Mb/s - 65 Working Days. |
Orders of more than 5 Access Connections at once have to be arranged as a project and standard leadtimes do not apply. |

Upgrades/Downgrades in Resilience Options. |
Charges for moving from a Standard Product to a Secure or Secure Plus product is the difference in connection charges, for example: |
Rental will be re-calculated based on new access speed and resilience type (see tables above) |
When a Customer wishes to move from 34Mbit/s to 100Mbit/s Flex, the upgrade charge will be the 100Mbit/s Flex Connection Charge less 40%. In addition, Customers must commit to move to 35Mbit/s or more and it will not be possible to regrade to any bandwidth lower than 35Mbit/s for the duration of the Contract Term for that Access Connection. |
Downgrade of an Access Connection option is not allowed during the first 12 months after installation. |
Resilience Downgrades are deemed to be when a customer moves to a lower form of Resilience for example: 2M Secure Plus downgrading to 2M Standard. |
Downgrades are priced at the full connection charge for the new service and rentals will be adjusted accordingly to reflect the change in access connection. |
A move to a lower speed is deemed as a downgrade and is charged at the full connection charge. |
Regrade Charges |
Customers may regrade between any of the IP Clear Access Connection options. |
Upgrades |
Change of Access speed up to 512K is charged at the difference in connection charges, however anybody upgrading to 2M from 128K, 256K or 512K will attract the full connection charge (£3000.00(Exc. VAT)). |
Upgrades may be requested at any time and rentals will be re-calculated following the upgrade. |
Upgrades are deemed to be the change of IP Clear service from a lower to a higher priced Access Connection. |
The upgrade charge will be the difference between the 100Mbit/s Flex and Gigabit Ethernet Connection Charges and the Customer must commit to 40Mbit/s or the bandwidth they were utilising on 100Mbit/s Flex (whichever is the higher) for the duration of the Contract Term for that Access Connection. |
Downgrades |
Downgrade of an Access Connection option is not allowed during the first 12 months after installation. |
Downgrades are deemed to be the change of IP Clear service from a higher to a lower cost Access Connection. |
Downgrades are priced at the full connection charge for the new service and rentals will be adjusted accordingly to reflect the change in access connection. |

Charges for infrastructure over and above standard requirements are given in BT Price List Section 45 Part These charges include work on internal trunking & traywork; breaking through walls; additional poles, ducts and cable; radio charges and miscellaneous non-standard or specially requested items. |

Cancellation Charges |
Customer orders for IP Clear will be taken as a project and managed accordingly with BT and the Customer working together to formulate a suitable agreed roll-out plan. Order placement can then be staggered according to the plan and Contractual Delivery Dates will apply (using the standard lead time of access circuits) unless a specific extension is agreed with the Customer. |
The delivery of a circuit is timed to meet a Contractual Delivery Date (CDD). The Cancellation Charges raised reflect the amount of work undertaken and are calculated on the number of Working Days between the date the Customer requests cancellation and the CDD. |
The Cancellation Charge is expressed as a percentage of the appropriate Connection Charge. |
Customers should note that once delivered, Access Connections have a standard 12 month minimum term for which rental will be due. |
The Customer must give the cancellation date in writing. |

Cancellation charges will not be raised if a customer cancels an order; - -more than 30 Working Days before CDD for products with a standard lead-time within 35 Working Days of date of Order.
- -more than 60 Working Days before CDD for products with a standard lead-time within 65 Working Days of date of Order.

Accesses Provided within 38 Working Days of Date of Order |
This relates to the following circuit types: 10M, 100M and 1000M Flex |

(i.e. one working week is allowed as a `cool off' period). |
The full cost of all additional work, (e.g. duct) which is separately identified on the Customer Requirements Form (CRF) and which has been specifically incurred as a result of that order will be fully recovered. This is in addition to the Cancellation Charge. |
Should the Customer request amendments to the CDD and subsequently cancel the order, the cancellation charge will be calculated from the date that the Customer notifies BT of the first amendment and the original CDD. |
Contract Options |
Term Contract Options |
The minimum contract term is 12 months. |
Customers may opt to enter into a 1, 3, 4 or 5 year Contract option. Prevailing rentals will be discounted for the duration of the contract according to the rates specified under the Unified Discount Scheme (Section 47 Part 3). |
The term commitment and the spend across the contributing products provide an appropriate discount across all of the products. For further details of this matrix, refer to Part `Unified Discount Scheme' of this Section. |
