Subpart 2:BT Business Mobile Sharer - before- orders on or after 1st December 2016 and before the 15th June 2017

All charges are stated exclusive of VAT. The charges detailed in this BT Price List Entry apply to Contracts for BT Business Mobile Sharer except as amended via a Charges Schedule provided by BT.

The Customer must not connect, continue connection or knowingly allow any third party to connect or continue the connection of:

(a) any GSM Gateway; or

(b) any device used to forward or divert calls, texts or data with the intention of reducing charges for that call, text or data; or

(c) any BT SIM Card used with an application enabling the making of automated calls and sending of automated data and texts,

to the Network. Where BT reasonably believes that the Customer is in breach of this, the Customer will provide, at BT's request, details of the means by which text and data is sent or calls made.

"GSM Gateway" means a single point of access to the Network from another network using BT SIM Cards and/or any facility enabling the making of automated calls and the sending of automated data and texts using BT SIM Cards and BT may suspend or terminate the Service in accordance with the Contract.

1. Definitions

The definitions are set out in the Conditions and Service Schedule - please see Paragraph 67 below for more information.

2. Minimum Period and Minimum Term

The following Minimum Period of Service and Minimum Term applies to BT Business Mobile Sharer, otherexcept than where a different Minimum Period of Service and Minimum Term is stated in the Charges Schedule:

(a) Monthly Subscription Charges will be invoiced monthly in advance.

(b) Monthly Subscription Charges incurred for periods of less than a month will be calculated on a pro-rata basis.

Secondary Connections are associated with each Primary Connection and the Inclusive Minutes and Inclusive Texts detailed in Table 1 are shared across the Primary and Secondary Connections.

(dd) IfData theonly Customersubscriptions terminateswill not include any inclusive minutes or text allowancea Primary Connection, the Customer must designate one of the Secondary Connections associated with the Primary Connection to become the Primary Connection and the Monthly Subscription Charge applicable to the Primary Connection will apply to that Secondary Connection from then on. If the Primary Connection was within its Minimum Term when terminated, the early termination charges will be the outstanding Monthly Subscription Charge applicable to a Secondary Connection due to the end of the Minimum Term and not that applicable to Primary Connection, provided that a Secondary Connection has been designated as the replacement Primary Connection. If the Customer fails to designate a Secondary Connection to replace the terminated Primary Connection, BT will designate one.

The following are included in the Monthly Subscription Charge for BT Business Mobile Sharer:

Note 3 - Inclusive Minutes Allowance

(a) The Inclusive Minutes Allowance set out in Table 1 above, can be used as follows:

  • (i) Voice Callscalls made within the UK to other UK mobile users ;
  • (ii) Voice calls made within the UK to UK fixed lines (01, 02, 03 and 07 numbers excluding Channel Islands and the Isle of Man), .
  • (iii) Voice Calls made within the UK to fixed lines and mobile users in the Republic of Ireland
  • (iv ) Voice Calls made within the UK to fixed lines and mobile users in the EU;

(b) The following call types are excluded from the Inclusive Minutes Allowance set out in Table 1 above:

  • (i) CallsVoice calls to non-geographic numbers
  • (ii) CallsVoice calls to directory enquiries
  • (iii) CallsVoice calls to premium rate services
  • (iv) International direct dial calls (except(Voice forcalls Republicmade ofin Irelandthe andUK EUto non UK numbers)
  • (v) International Roaming calls.
  • (vi) Calls to voicemail
  • (vii) Calls to BT Mobile and EE mobile users

(c) The Inclusive Minutes Allowance applies to the Primary Connection and its associated Secondary Connections and cannot be shared across other accounts and will apply on a pro-rata basis in the first month.

(d(c) Any unused minutes from the Inclusiveinclusive Minutesminutes Allowanceallowance will not be carried forward to the following month.

Note 4 - Inclusive Call Allowance

(a) A 3000 minute Inclusive Call Allowance applies per Primary and Secondary Connection for voice calls. This applies in addition to the Inclusive Minutes in Table 1 to:

  • (i) Voice calls between Connections or from a Connection to another BT Mobile user in the UK (where both the caller and the recipient are using a SIM Card provided by BT); and
  • (ii) Voicemail retrievals from a Connection.

(b)These calls are at no extra cost. Once the Inclusive Call Allowance is exhausted, the following will apply:

  • (i) Voice calls between Connections or from a Connection to another BT Mobile user in the UK (where both the caller and the recipient are using a SIM Card provided by BT) will decrement the Inclusive Minutes; and
  • (ii) Voicemail retrievals will be charged in accordance with Part 6 of Section 10 b of the BT Price List.

(c) The Inclusive Call Allowance will apply on a pro-rata basis in the first month.

(d) Any unused minutes from the Inclusive Call Allowance will not be carried forward to the following month.

Note 5 - Inclusive Texts Allowance

(a) The Inclusive Texts Allowance set out in Table 1 above, can be used for texts to any UK mobile networks but excludes:

  • (i) textstext messagesto tonetworks networksoutside ofoutside the UK;
  • (ii) MMS;
  • (iii) textstext messages sent whilstfrom outside of the UK; or
  • (iv) textstext messages to premium rate services.

(b) TheAny unused texts from Inclusive Texts Allowance applies to the PrimaryInclusive ConnectionTexts andAllowance itswill associated Secondary Connections and cannotnot be sharedcarried acrossforward otherto accountsthe andfollowing will apply on a pro-rata basis in the first month.

(c) Any unused texts from Daily Roaming the Inclusive Texts Allowance will not be carried forward to the followingin month.the Europe Zone or Travel Zone

Daily Roaming allowances per Connection per day are as set out in Table 3 above.

(a) The inclusive calls allowance set out in Table 3 above, can be used as follows:

(i) Voice calls made within the Europe Zone or Travel Zone to UK mobile users and UK landlines (01, 02, 03 and 07 numbers excluding Channel Islands and the Isle of Man);

(ii) Calls received while Roaming in Travel Zone countries;

(iii) Voice calls made from within the Europe Zone to mobile users and landlines within the Europe Zone;

(iv) Voice calls made from within the Travel Zone to mobile users and landlines within the Travel Zone.

(b) The following call types are excluded from the inclusive minutes allowance set out in Table 3 above:

(i) Voice calls to countries outside the Europe Zone and Travel Zone;

(ii) Calls made while Roaming outside the Europe Zone and Travel Zone.

(c) The inclusive text allowance set out in Table 3 above, can be used as follows:

(i) Text messages sent from within the Europe Zone or Travel Zone to UK mobile users;

(ii) Text messages sent from within the Europe Zone or Travel Zone to Europe Zone or Travel Zone mobile users.

(d) The following call types are excluded from the inclusive text allowance set out in Table 3 above:

(i) Text messages sent to mobile users outside the Europe Zone and Travel Zone;

(ii) Text messages sent while Roaming outside the Europe Zone and Travel Zone;

(iii) MMS.

(e) The inclusive data allowance set out in Table 3 above, can be used as follows:

(i) Data usage while Roaming in the Europe Zone or Travel Zone.

(f) The following call types are excluded from the inclusive data allowance set out in Table 3 above:

(i) Data usage while Roaming outside the Europe Zone or Travel Zone.

(g) The daily Charge will be as set out in Table 2 above, under the heading ?Daily Roaming Charge in Europe and Daily Roaming Charge in Travel Zone? and will be applied in addition to the monthly subscription Charge applicable to the Connection.

(h) The daily Charge will only be incurred by the Customer when the daily Roaming allowance is activated as a result of the Customer roaming to a qualifying country and using a BT SIM Card.

(i) The daily Charge will apply up to midnight local time regardless of when the daily Roaming allowance is activated during a day.

(j) Any unused daily Roaming allowance will not be carried over to the next month.

(k) BT will not provide a credit to the Customer for any unused allowances.

(l) The daily Roaming allowance is in addition to any other allowances within the Customer?s BT Business Mobile Sharer inclusive allowances and usage of the daily Roaming allowance will not decrement any allowances within the Customer?s BT Business Mobile Sharer inclusive allowances.

(m) Any usage in excess of the daily Roaming allowance will be charged for in accordance with Section10b Part 6 of the BT Price List.

(n) The countries included in the Europe Zone and Travel Zone are list in Table 6 and Table 7 below.

Note 6 - Unlimited BT Wi-fi

(a) Unlimited BT Wi-fi applies to all Connections (Primary and Secondary) for the Minimum Term of the Connection.

(a(b) The unlimited BT Wi-fi is for use from a BT Wi-fi Site in the UK.

(b(c) The unlimited BT Wi-fi will be provisioned in the form of a voucher which the Customer will receive by email to the contact email address provided by the Customer to BT.

(c(d) The Customer can connect to BT Wi-fi hotspots via the BT Wi-fi application downloaded from the relevant app store supported by their device subject to the BT Wi-fi application being available for the Customer's device. The Customer canwill enter the credentials into the BT Wi-fi Login screen in their browser when they connect to a hotspot. or by using the BT Access Manager when using the BT USB Modem Device.

(d(e) Roaming using BT Wi-fi is not available with the Service. Roaming (which means using BT Wi-fi partner networks in the UK or abroad) canmay be obtained via a BT Wi-fi International Voucher which can be purchased at www.btwifi.com/buy. The vouchers are subject to the terms and conditions available at http://www.btwifi.com/terms-and-conditions/conditions-for-wifi-service.jsp.

Extra Speed 4G

(a) Extra speed 4G applies to all Connections for the Minimum Term of the Connection.

(b) With extra speed 4G, the maximum speed available through the network is capped at 60 Mbps rather than 30 Mbps on our standard 4G. The speeds the Customer will receive will be lower, and depend on factors such as the number of users, distance from the mast and the type of 4G handset used.

Note 7 - BT Business Mobile Care

BT Business Mobile Care applies to all Connections and includes:

(a) Dedicated business support: Access to the BT Business Mobile customer service teams.

(b) Within Replacement of warranty replacement of Devices: withinthe manufacturer's warranty: theon manufacturer'Devices is provided via BT - where a Device is faulty within the terms of the warranty, BT will replace thiss withwarranty anon equivalentDevices isDevice byprovided thevia end of the next working day. BT reserves- where athe rightDevice to supply refurbishedis devices.faulty within the terms of the warranty, BT will replace this with an equivalent Device by the end of the next working day. BT may supply Refurbished Devices.

(c) 90-day early upgrade: Customers canmay choose to upgrade their BT Business Mobile plan up to 90 days before the end of their Minimum Term, which may include a new Device dependentdepending uponon the plan chosen. Any outstanding Minimum Term remaining at the point of resign will be added to the Minimum Term applicable to the new plan.

(d) Business voicemail: all Connections come with BT Business Mobile voicemail accounts. BT reservesmay the right to de-active inactive voicemail accounts.

(e) Out of the box: Access to help and resources to get started with BT Business Mobile, including Device set-up and transferring content from other devices.

4. BT Business Mobile Extras

Part 4 of Section b of the BT Price List sets out the BT Business Mobile Extras available with BT Business Mobile Sharer and the terms and conditions (including the charges) which apply.10b of the BT Price List sets out the BT Business Mobile Extras available with BT Business Mobile Sharer and the terms and conditions (including the charges) which apply.

BT Business Mobile Sharer Connections are eligible for the following BT Business Mobile Extra on BlackBerry BES 12 Silver.

(a) The additional monthly subscription Charge applicable to BlackBerry BES 12 Silver Cloud Account is an additional Charge and applies per Connection in addition to the monthly subscription Charge applicable to the Connection to which BlackBerry BES 12 Silver Cloud Account AC is added.

(b) BlackBerry BES 12 Silver Cloud Account will be applied to all Connections on the account.

(c) The Minimum Term applicable to BlackBerry BES 12 Silver Cloud Account is 24 months.

(d) Once BlackBerry BES 12 Silver Cloud Account is added to a Connection any removal of BlackBerry BES 12 Silver Cloud Account from that Connection during the Minimum Term will incur a Termination Charge equal to the outstanding additional monthly subscription Charge applicable to BlackBerry BES 12 Silver Cloud Account due to the end of the Minimum Term. Where a Connection is terminated within its Minimum Term the additional monthly subscription Charge applicable to BlackBerry BES 12 Silver Cloud Account will be included in any calculation of early Termination Charges.

(e) Other terms associated with BlackBerry BES 12 Silver Cloud Account can be found in Section 10b Subpart 1BT Business Mobile Extras .

5. Usage Charges

Usage Charges unless stated in Table 4 below can be found in Section 10b Part 6BT Business Mobile Standard, International and Roaming Charges .

56. Usage Limits

Usage limits may apply to the Customer's account and/or BT SIM Card. It is the responsibility of the Customer to monitor their mobile spend and data usage.

International Roaming Limits

In order to comply with EU Regulation BT may apply a usage limit for international data use ("Data Roaming")*. This limit will be applied to the BT SIM Card and will apply per billing month. The user of the BT SIM Card will be sent 2 alerts advising them that they are approaching the limit set by BT and providing guidance on how to contact BT about the limit. Upon reaching the limit, the user of the BT SIM Card will receive a final text alert advising that Data Roaming will be suspended unless BT is contacted by the bill payer/Account holder. Please refer to http://www.bt.com for more information about these limits and alerts. Contact details for BT will be included in the alert.

*the Data Roaming default limit is set at 50 Euros, when applying this limit BT will use the exchange rate published for this purpose at http://www.bt.com

UK Data Usage Cap

Once a BT SIM Card user has used any inclusive data allowance and/or additional data extras in any given billing month, BT will charge the Customer on a per MB basis for any further data usage as detailed in Part 6, Section 10b of the BT Price List, unless stated otherwise in the Charges Schedule.

BT may apply a cap on UK data usage above a BT SIM Card user?s inclusive data allowance and/or UK data extras, which will stop further use of data in the UK for the remainder of the billing month (?UK Data Usage Cap?).

BT will send the BT SIM Card user an SMS alert when they have gone over any inclusive data allowance and/or UK data extras, alerting them that further UK data usage will be charged on a per MB basis. Upon reaching the UK Data Usage Cap, the BT SIM Card user will receive a further SMS alert advising them that the UK Data Usage Cap will be placed. Please note that the SMS alerts and UK Data Usage Cap are not administered in real time, and may be subject to a delay, which means that the BT SIM Card user may incur charges for usage beyond the UK Data Usage Cap.

The UK Data Usage Cap will be lifted by BT at the start of the Customer?s next billing period. The Customer may request that BT lifts the UK Data Usage Cap prior to the end of the then current billing period. BT will only lift the UK Data Usage Cap where there are no outstanding charges on the Customer?s accounts.

Customers, including those who are able to opt out of the UK Data Usage Cap, will be charged for all data usage above any inclusive data allowance and/or UK data extras.

BT may change the UK Data Usage Cap without notice.

Please note that some devices (those without text functionality) may not receive the alerts with respect to Data Roaming and the UK Data Usage Cap.

(a) As the data allowance is included in the plan can be used in the EU:

(i) The Customer agrees that they will be opted out of the monthly EU Regulated 50 Euro data spend limit for roamed data used anywhere outside of the UK. This is because the Customer will have an inclusive European allowance within their plan.

(ii) The Customer agrees that they will be opted into the 50 euro Rest of the World monthly spend data cap whilst Roaming outside the Europe Zone.

(b) The Customer can opt in to the monthly EU Regulated 50 euro data spend limit at any time If the Customer opts back in, all data usage outside will be capped at 1082.43MB (regardless of how much inclusive data they have on their plan ).

OR

(c) The Customer can opt to remove all Roaming spend caps, at any time, subject to credit checks and approval. If the Customer selects this option they will not receive any spend alerts or capping when Roaming anywhere outside the UK.

(d) Where the Customer has opted for either the monthly EU Regulated 50 euro data spend limit or the 50 euro Rest of the World monthly spend data cap ;

(e) These limits will be applied to the BT SIM Card and will apply per billing month. The user of the BT SIM Card will be sent 2 alerts advising them that they are approaching the limit set by BT and guidance on how to contact BT about the limit. Upon reaching the limit, the user of the BT SIM Card will receive a final text alert advising them that Data Roaming will be suspended unless the bill payer/Account holder contacts BT.

UK and Europe Zone Out of Bundle Data Usage Cap

(a) Once a BT SIM Card user has used any inclusive data allowance and/or additional data extras in any given billing month, BT will charge the Customer on a per MB basis for any further data usage as detailed in Part 6, Section10b of the BT Price List, unless stated otherwise in the Charges Schedule.

67. Conditions

(a) General

The Contract for BT Business Mobile Sharer comprises:

  • (i) ThisThe BTCharges PriceSchedule List;(where one is provided), including the Order;
  • (ii) ConditionsThe for BT BusinessPrice Services (BT1130);
  • List; (iii) Service Schedule for BT Business Mobile Service (BT1147);
  • (iv(iii) The WelcomeBT LetterBusiness whereMobile thisSchedule statesto it forms part of the ContractGeneral orTerms (thethe Charges?Schedule?) Scheduleincluding whereany oneAnnex is provided; and
  • (v(iv) The AnnexGeneral to the Service Schedule (BT1147a) where the Customer'Termss Contract includes a service or option listed in the Annex.;
  • (v) The Welcome Letter (where this states it forms part of the Contract); and
  • (vi) any other documentation expressly incorporated by any of these documents or by agreement between BT and the Customer.

(b) BT Business Mobile Extras

Where a BT Business Mobile Extra is applied to a Connection, the Contract will incorporate the terms and conditions applicable to the BT Business Mobile Extra (as detailed in Part 4 of Section b of the BT Price List).10b of the BT Price List).

(c) BT Business Mobile Care is provided under the Customer's Contract for BT Business Mobile Sharer:

  • (i) AllReplacement datesof areDevices estimates.
  • is subject to the warranty terms set out in the Schedule. (ii) Replacement of Devices is subject to the terms and conditions applicable to the warranty, details of which can be found in the Service Schedule for BT Business Mobile Service.
  • (iii(ii) BT will de-active any mailboxes that are inactive for 3 consecutive months. A chargeA Chargemay mayapply applyfor forre-activating re-activatingthe themailbox. mailbox.BT BTwill willcharge chargefor forcalls callsto tovoicemail as set out abovevoicemail.

78. Termination Charges

Where the Customer terminates the Contract, the Service, part of the Service or a Connection during the Minimum Term of any Connection, the terminationTermination chargesCharges detailedwill apply as set out in the WelcomeSchedule. Letter (where this states it forms part of the Contract) will apply. Where such a Welcome Letter is not received, the termination charges will be as detailed in the Charges Schedule.
