Subpart 5:Performance Scheme for Repair

Private Circuits Performance Scheme assures the Customer of BT's commitment to supplying a high level of service. This commitment, underwritten by Private Circuit's Reduced Charges Scheme and product specific performance schemes, reduces the Customer's rental charges if our performance targets are not met.

With the exception of products with a StandardCare maintenance level, Customers will automatically receive a reduction on their annual rental if BT fails to meet the prescribed timescale for repairing a qualifying fault on their circuit. All digital private circuits have the ServiceCare level of TotalCare (with a 5 clock hour repair target for private circuits) included within their annual rental. Analogue circuits have the ServiceCare level of PromptCare (or in some instances StandardCare) included within their annual rental.

Reduced Charges Calculations

General Conditions

i.For the purpose of the Scheme, a delayed repair will become eligible for a reduction (deemed an eligible failure) only if the reported fault causes ?total loss of service" (i.e. no transmission of signals in one or both directions) The total loss of service must occur for the duration of the qualifying period and is on the circuit or associated network equipment between the Network Terminating Points. The loss of service must be reported to a BT fault reporting point. Once reported and logged the fault repair clock will begin.

ii.An eligible failure means:

  • -for circuits with StandardCare as their ServiceCare level, a failure that continues for more than 2 clear working days after the day it has been reported to BT by the customer,
  • -for circuits with PromptCare as their ServiceCare level, a failure that continues for more than 10 working hours after it has been reported to BT by the customer;
  • -for circuits with TotalCare as their ServiceCare level, a failure that continues for more than 5 clock hours after it has been reported to BT by the customer;
  • -for circuits with DealerCare as their ServiceCare level, a failure that continues for more than 2 working hours between the hours of 0700 and 1900 Monday to Friday, after it has been reported to BT by the customer;
  • -for circuits with TotalCare as their ServiceCare level, a period of 24 hours commencing at any time
  • -for circuits with PromptCare as their ServiceCare level, a period of 9 working hours commencing at any time during working hours;
  • -for circuits with StandardCare as their ServiceCare level, Monday to Friday, 0800hrs to 1700hrs, excluding Public and Bank Holidays (as applies locally).
  • -a period of one hour occurring Monday to Saturday, 0800hrs to 1700hrs, excluding Public and Bank Holidays (as applies locally).

iii.Any reductions due as a result of the Reduced Charges Scheme will only apply to the circuit rental and not to any associated equipment or maintenance charges.

iv.Circuits with the ServiceCare level's of TotalCare, PromptCare, DealerCare or DealerCare Plus will receive either the cash per working day reduction or a percentage reduction whichever is the greatest, up to a maximum 100% of the annual rental for the period covered by the Reduced Charges Cycle. Refer to the table and exceptions above for per day and percentage values for a given Reduced Charges cycle.

v.Circuits with the ServiceCare level of StandardCare will be able to claim the cash per working day reduction, of which the cumulative amount is limited to 100% of the annual rental for the Reduced Charges cycle.

vi.In all cases, the calculated reduction will be deducted from the amount due for the circuit rental for the following year unless the circuit is terminated in which case a specific payment will be made.

vii.The daily rate will apply on the working day the failure becomes eligible and each working day thereafter until the failure is repaired. ?Working days" means: ?Working hours" means:

viii.The Reduced Charges Scheme does not apply to any failure of a circuit arising from any suspension of the circuit for breach of the contract by the customer or in case of the paragraphs referring to ?BT's general powers"or ?Matters beyond BT's reasonable control" contained in BT's Conditions for Private Service.

ix.The Reduced Charges Scheme does not apply to inland tails of Offshore and International private circuits and Private circuits to Other Administrators.

x.Own exchange AccessLine circuits wishing to upgrade from StandardCare to PromptCare or TotalCare must first convert to an equivalent Analogue private circuit. Charges for this conversion will apply at the rates shown in Part 1 of this section. Following conversion the details in Part 1 of this section `Analogue' will apply.

xi.Faults reported on a private circuit, or a spur of a Multipoint or Omnibus circuit, will be deemed to affect only that private circuit or spur, even if the problem affects other private circuits, spurs and/or associated main private circuit.

Additional Conditions Specific to NetStream 2000 Hub, Genus & Digital Performance Schemes

i.These conditions are in addition to the conditions outlined below for other private circuits products and services.

ii.BT will identify that a fault reported by the customer to BT is within the BT network and is a failure of a NetStream circuit and will commence recording unavailable time.

iii.A failure of a NetStream circuit caused by a fault on a telecommunications network(s) other than BT's network will not be time recorded and the Digital Performance Scheme will not apply.

iv.Time recording of the period during which a failure of a NetStream circuit persist will cease when BT restores the NetStream circuit and has attempted to contact the customer. This will apply even though the customer is not available to turn on or reset the customer's apparatus. Time recording will cease if the customer fails to co-operate with BT or allow access to the customers premises or fails to take any reasonable steps considered necessary by BT to enable it to repair the failure of the NetStream circuit.

v.BT will keep a record of the unavailable time for each 12 month period which shall commence on the Actual Delivery Date and each anniversary thereafter. Unavailable time will be accumulated as a total for the 12 month period in which the NetStream circuit is restored. Unavailable time will be carried forward for circuits which undertake a single end rearrangement and the percentage reduction will be applied to the appropriate annual rentals on a pro rata basis.

vi.Time recording will operate in units of a clock minute.

vii.The NetStream hub or genus scheme will not apply if:

  • The NetStream Circuit is being modified, altered, amended or any other work is being carried out on the NetStream circuit service at the customers request.
  • Failure is due to faults on customer equipment.
  • Failure is due to faults caused by customer action.
  • The customer has requested BT to test the NetStream Circuit or has agreed that the NetStream circuit should be tested other than when a failure has been reported.
  • The customer will not release the NetStream Circuit to BT to enable it to test the circuit and trace the failure.
  • The NetStream Circuit has been installed for less than one year.

viii.In circumstances where the NetStream hub, genus and 16 scheme applies, the reduction in the rental for the year in which unavailable time was recorded is calculated using the percentages given in the table above and the annual rental figure current at the time of calculation. The tables are applied separately to each applicable NetStream circuit by the NetStream scheme.

ix.The effective start date of the Digital Performance Scheme will be agreed with the customer on a Access Site by Access Site basis, once the eligibility criteria has been met. Reduction in the rental will be calculated one year after the effective start date.
